Pink Tax Repeal Act
The Pink Tax Repeal Act would bar pricing differences based on gender for two categories: consumer products from the same manufacturer that are substantially similar, and services that are substantially similar. In effect, it targets “pink tax” pricing by prohibiting a manufacturer from selling two nearly identical products at different prices solely because they are marketed to different genders, and by prohibiting services from being priced differently by gender when the services are substantially the same. The Federal Trade Commission would enforce the ban as an unfair or deceptive practice, and state Attorneys General could sue on behalf of residents. The bill provides definitions and criteria for what counts as “substantially similar,” outlines enforcement mechanisms, and clarifies interactions between federal and state authorities. Overall, the act seeks to reduce gender-based price discrimination in consumer markets and give federal and state enforcers new tools to address these practices.
