Outdoor Recreational Outfitting and Guiding Act
This bill would create a new federal exemption under the Fair Labor Standards Act (FLSA) for certain workers who are predominantly involved in outdoor recreational outfitting or guiding services. If the employer qualifies as a seasonal business (not operating more than seven months in a calendar year) or has highly seasonal receipts (one half of the year accounts for at most one-third of total receipts compared to the other half), these employees would be exempt from federal minimum wage and overtime requirements. The exemption applies to workweeks beginning on or after enactment. In short, the bill aims to reduce wage obligations for workers in seasonal outdoor recreation businesses by shifting them into an exempt category if the employer meets the stated seasonal criteria.
