A bill to provide additional funding to States that provide certain rights to sexual assault survivors, and for other purposes.
This bill would create new incentives for states to adopt and maintain certain rights for sexual assault survivors by expanding and structuring funding under a federal grant program. Specifically, it amends the National Defense Authorization Act for Fiscal Year 2023 to (a) increase grant funding to states that have enacted rights for sexual assault survivors—either exactly as described in 18 U.S.C. § 3772 or through substantially similar laws, regulations, practices, or policies; (b) set a three-tier funding allocation based on the level of survivor-rights enacted; (c) require evidence kits to be preserved for at least 20 years; and (d) simplify the process for notifying survivors about disposal or preservation of evidence kits (removing the requirement for a written notice request). The overall intent is to encourage states to implement survivor-rights protections by tying funding to demonstrated compliance with those rights.
