COAL POWER Act
The COAL POWER Act would repeal a specific Environmental Protection Agency (EPA) rule that conducted a residual risk and technology review (RTR) for coal- and oil-fired electric utility steam generating units, under the national emissions standards for hazardous air pollutants (NESHAP). The bill states that the final EPA rule titled “National Emission Standards for Hazardous Air Pollutants: Coal- and Oil-Fired Electric Utility Steam Generating Units Review of the Residual Risk and Technology Review” (published May 7, 2024) shall have no force or effect and shall be treated as if it never took effect. In short, the bill seeks to undo that RTR rule and return to the regulatory status quo prior to its publication. The bill is titled the Combating Overregulation And Limitation of Proven, Operable, Working Energy Resources Act, or the COAL POWER Act. It does not add new standards or modify existing ones beyond nullifying the 2024 RTR rule.
