Patriots Over Politics Act

The Patriots Over Politics Act would amend 38 U.S.C. to create a temporary, 90-day window during which certain Service members who were discharged for refusing to receive a COVID-19 vaccination could transfer their Post-9/11 GI Bill educational benefits to eligible dependents. The transfer would be based on the member’s separation date and would allow the recipient dependent to begin using the transferred benefits after the service member has completed at least six years of service. The eligible group is limited to those discharged between August 24, 2021 and January 10, 2023 specifically for vaccine-refusal, and the transfer would occur notwithstanding other laws. In short, the bill provides a one-time, short-term opportunity to move education benefits to dependents for a narrowly defined group of veterans.
