Advancing Skills-Based Hiring Act of 2025
The Advancing Skills-Based Hiring Act of 2025 would create a voluntary compliance assistance program at the Equal Employment Opportunity Commission (EEOC) to help employers use employment tests and selection procedures that are based on skills. Employers could voluntarily submit validity evidence (such as studies showing a test predicts job performance) to EEOC, which would review the evidence to determine if the test or procedure is job-related and consistent with business necessity. If EEOC makes that determination, employers may cite it as a safe harbor in meeting their Civil Rights Act burden of proof. The bill also imposes a fee for reviews by larger employers, provides education and technical assistance from EEOC, and protects submitted information from use in enforcement actions or in court without consent. The act would take effect 90 days after enactment.
