Directing the President pursuant to section 5(c) of the War Powers Resolution to remove United States Armed Forces from unauthorized hostilities in the Islamic Republic of Iran.
H. Con. Res. 38 is a concurrent resolution introduced in the House that uses the War Powers Resolution (WPR) section 5(c) mechanism to direct the President to end United States military hostilities in the Islamic Republic of Iran. It argues that there has been no declaration of war or specific statutory authorization for such hostilities and, therefore, directs the President to terminate U.S. armed forces’ involvement unless Congress later provides a declaration of war or a specific authorization for use of military force (AUMF). The resolution preserves a narrow self-defense exception and includes clarifications about intelligence-sharing practices, while reiterating that the resolution itself does not authorize the use of force. As a concurrent resolution (not a statute), it expresses Congress’s position and, if enacted, would guide the President under the War Powers framework but would not itself create new legal authorities or compel action beyond the WPR mechanism. The bill is introduced and referred to the House Committee on Foreign Affairs; it does not become law by itself.
