A bill to require the Committee on Foreign Investment in the United States to annually review, update, and report on the facilities and property of the United States Government determined to be national security sensitive for purposes of review of real estate transactions under section 721 of the Defense Production Act of 1950.
This bill would elevate and formalize the ongoing handling of certain U.S. government facilities and properties as national security sensitive assets within the Committee on Foreign Investment in the United States (CFIUS) framework. It adds a statutory mechanism to create and regulate a list of government facilities and property that are sensitive for national security reasons, potentially including intelligence-community sites and National Laboratories. Each year, members of CFIUS would individually review the relevant sites assigned to their agency, prepare a report with recommended updates, and have those updates incorporated into the official list. The bill also expands reporting requirements to include notices and reviews of transactions related to these sensitive sites and allows for classified briefings to Members and staff.
