Stop Unlawful Detention and End Mistreatment Act of 2025
The Stop Unlawful Detention and End Mistreatment Act of 2025 would require the Secretary of Homeland Security to create a publicly accessible online immigration detention database. This database would provide detailed, non-identifying information about individuals in U.S. Immigration and Customs Enforcement (ICE) custody, including the legal authority for detention, detention duration, current location (with certain privacy exceptions), transfers, and whether removal orders exist. It would also collect information on the detained population overall (demographics, disciplinary actions, deportations) and on any non-traditional detention locations (such as certain Department of Defense facilities, lands on Indian tribal lands, or locations outside the continental U.S.), including justification, bed counts, care standards, costs, and related agreements. The bill also requires sharing open or unresolved recommendations from oversight bodies and the planned timeline or rationale for implementing those recommendations. The database must be updated daily, with older data archived annually, and no personally identifiable information (PII) would be included. The measure also preserves the ongoing operation of two DHS offices (the Immigration Detention Ombudsman and the Office for Civil Rights and Civil Liberties) as long as funding is available. Non-traditional locations are narrowly defined to include DoD properties, tribal lands, or locations outside the continental U.S.
