Restoring Judicial Separation of Powers Act
The Restoring Judicial Separation of Powers Act would overhaul how federal appellate review and emergency-relief rulings are handled, with a goal of shifting more authority away from the Supreme Court and toward the District of Columbia Circuit (DC Circuit) and a new multi-circuit panel. Key changes include moving direct appeals and final district-court decisions away from the Supreme Court to the DC Circuit, creating a rotating 13-member multi-circuit panel to review certain high-stakes federal or constitutional questions, and adding rules aimed at limiting nationwide injunctions and “shadow docket” activity. The bill also requires courts to provide written, publicly posted explanations when reversing prior decisions. If enacted, these changes would take effect October of the year after enactment (for Title I) and immediately for Title II provisions.
