Asbestos Exposure in Housing Reduction Act of 2025
The Asbestos Exposure in Housing Reduction Act of 2025 would require new federal regulations to mandate disclosure of asbestos hazards in the sale or lease of certain residential dwellings. Within two years of enactment, HUD and the EPA would jointly issue rules requiring sellers/lessors to disclose known asbestos and asbestos-based hazards, provide any available hazard evaluation reports, and allow a 10-day window for prospective buyers or renters to conduct risk assessments or inspections before becoming obligated under a contract. Contracts for sale or lease would need to include an Asbestos Warning Statement that the purchaser or lessee signs, acknowledging they have read the warning and had the opportunity to inspect. The bill imposes penalties for violations, creates civil liability for damages, and authorizes enforcement actions. It also defines key terms, sets an effective date for the regulations, and authorizes appropriations to carry out the provisions. Notably, the definition of “dwelling” targets pre-2019 construction, meaning most newer homes would be exempt. In short, the bill aims to improve transparency about asbestos hazards in older housing transactions and give prospective buyers and renters a formal opportunity to assess and address asbestos risks before signing a contract.
