Border Patrol Supervisors Retention Act
Border Patrol Supervisors Retention Act would broaden the group of U.S. Border Patrol employees eligible for higher rates of regularly scheduled overtime pay (often called “special overtime pay”). Specifically, it amends the law that governs special overtime pay (5 U.S.C. 5550(h)) to include Border Patrol agents classified from GS-12 through GS-15 (instead of only GS-12). The aim is to improve retention of higher-graded or supervisory Border Patrol personnel by providing them with access to higher overtime compensation. The bill does not create a new pay rate itself; rather, it expands eligibility within the existing framework for special overtime pay. It was introduced in the Senate on July 10, 2025, by Senator Lankford (for himself and Senator Kelly) and referred to the Homeland Security and Governmental Affairs Committee.
