Drug and Alcohol Clearinghouse Public Safety Improvement Act of 2025

The Drug and Alcohol Clearinghouse Public Safety Improvement Act of 2025 would amend the Federal Motor Carrier Safety Administration (FMCSA) program to require the submission of positive hair drug test results to the Drug and Alcohol Clearinghouse. Specifically, carriers with vehicles weighing 10,000 pounds or more must promptly report positive hair test results from pre-employment or random drug tests that are conducted using a device cleared under FDA 510(k). The bill sets laboratory requirements—tests must come from College of American Pathologists (CAP) accredited forensic hair testing labs and, when available, follow Department of Health and Human Services (HHS) guidelines. It also directs the Transportation Secretary to issue implementing regulations within one year, including updating the regulatory definition of “actual knowledge” to include these hair test results. The overall aim is to broaden the Clearinghouse’s data to strengthen public safety by improving visibility into positive drug test results among commercial drivers.
