Fair Pharmacies for Federal Employees Act of 2025
The Fair Pharmacies for Federal Employees Act of 2025 would bar the Office of Personnel Management (OPM) and Federal employee health plan carriers in the Federal Employees Health Benefits Program (FEHBP) from contracting with health plan entities that directly or indirectly own or control pharmacies, or that are owned or controlled by pharmacy benefit managers (PBMs). It also prohibits those same FEHBP entities from contracting with PBMs that themselves own or control pharmacies. The goal is to prevent anti-competitive ownership structures and conflicts of interest between PBMs and pharmacies in federal employee health benefits, potentially leading to fairer negotiation, more transparent networks, and better access for federal employees. The bill includes broad definitions of pharmacies and PBMs to cover a wide range of entities and arrangements, and leaves existing enforcement authorities (e.g., FTC, DOJ, HHS, state attorneys general) intact.
