Pesticide Injury Accountability Act of 2025
The Pesticide Injury Accountability Act of 2025 would amend the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to create a new private right of action. Specifically, it would allow any person or any person’s property that is injured by a pesticide to sue the pesticide’s registrant in federal district court for monetary damages. The damages could include both compensatory (to cover actual losses) and punitive damages (to punish particularly wrongful conduct), at the court’s discretion. Attorney’s fees and court costs would not be recoverable. Importantly, the bill states that this new private right of action would not preempt state-law claims, so plaintiffs could pursue state tort claims in parallel. The act also reorganizes the FIFRA sections to accommodate this new provision.
