Small and Homestead Independent Producers Act of 2025

This bill, titled the Small and Homestead Independent Producers Act of 2025, would create a federal pathway for small cannabis cultivators and small cannabis product manufacturers to ship cannabis and cannabis products through the mail to adults in states where possession is lawful. It would authorize shipments via the U.S. Postal Service or private interstate carriers, establish a 21-year-old age requirement with verification for deliveries, and set thresholds to define who qualifies as a “small” cultivator or manufacturer. The bill would amend federal law to allow mailing cannabis under regulations and would preempt certain state laws to permit interstate shipments to lawful destinations, while preserving states that prohibit cannabis (with limited exceptions for interstate transport). The act would take effect only after cannabis is removed from the federal schedule and federal penalties for cannabis offenses are eliminated.
