Plain Prescription Prices Act
The Plain Prescription Prices Act would require certain direct-to-consumer (DTC) television ads for prescription drugs and biological products that are covered by Medicare or Medicaid to include a truthful, non-misleading statement of the list price for a typical 30-day regimen or course of treatment. The price shown must reflect the list price on the first day of the quarter in which the ad airs. The Secretary of Health and Human Services, via the CMS Administrator, must issue regulations within one year outlining how this price text should appear, whether the rule should extend to other forms of advertising, enforcement mechanisms, and any additional price information to include. The bill establishes a framework for price transparency in DTC ads and leaves room for regulatory expansion.
