CAP Act of 2025

The CAP Act of 2025 (S. 2567) would end the H-1B visa cap exemption currently enjoyed by employees of institutions of higher education. By striking subparagraph (A) of Section 214(g)(5) of the Immigration and Nationality Act (INA) and reordering the remaining provisions, H-1B workers employed by colleges and universities would no longer be exempt from the annual H-1B numerical limit. As a result, new H-1B hires at higher education institutions would be subject to the general H-1B cap (and lottery) alongside other employers. Other cap-exempt categories would remain in place but would be renumbered accordingly. The bill’s stated title is the Colleges for the American People Act of 2025 (CAP Act of 2025).
