A bill to allow for the use of risk-based inspections for in-service breakout tanks.

This bill would let owners or operators of pipeline facilities use risk-based inspections (RBI) for in-service breakout tanks to meet federal inspection requirements. In other words, instead of following only fixed, one-size-fits-all inspection schedules, facilities could use a risk-based approach to determine which tanks require inspection and how often, as long as they still comply with applicable federal rules for pipeline safety. The bill also directs the Secretary of Transportation, through PHMSA, to update the relevant regulations to authorize RBI for these tanks. In effect, the bill creates a pathway to use RBI for in-service breakout tanks and requires the regulatory agency to rewrite the implementing rule (49 CFR 195.432) to reflect this change as soon as practicable after enactment.
