Ban Harmful Food Dyes Act

The Ban Harmful Food Dyes Act would, starting January 1, 2027, treat a specified list of color additives as unsafe for use in food and deem any food bearing those additives adulterated under the Federal Food, Drug, and Cosmetic Act (FD&C Act). In effect, foods containing these dyes (or additives substantially similar to them) could not be legally sold. The bill overrides existing color-additive listings and certifications under the FDA’s color additive process (section 721) once the 2027 date arrives. The bill defines the covered additives to include ten specific dyes (and titanium dioxide) plus any additives substantially similar to them. The measure is titled the Ban Harmful Food Dyes Act.
