Wheelchair Right to Repair Act

Wheelchair Right to Repair Act would create a targeted exception to copyright circumvention under the DMCA to allow diagnosis, maintenance, and repair of powered mobility devices (including motorized wheelchairs and wearable robotic devices). It requires original equipment manufacturers (OEMs) to make essential diagnostic documentation, parts, embedded software/firmware, and other repair tools available to independent repair providers and device owners on timely and fair terms. The bill also obligates OEMs to provide access to tools necessary to disable and reset security features used during repair, via a secure data release system. It establishes a process for requests, requires notices with purchases, and mandates consumer-facing notices to intended users. Enforcement would be shared between the Federal Trade Commission (FTC) and state attorneys general, with liability protections for OEMs/authorized repair providers unless damage results from device design/manufacturing defects. The act includes definitions of key terms and protections for trade secrets, while preserving existing warranty and recall arrangements.
