Critical Infrastructure Security Act
The Critical Infrastructure Security Act would change how the Committee on Foreign Investment in the United States (CFIUS) reviews real estate-related transactions. It expands the scope of what counts as a covered transaction to include facilities or property held by the intelligence community or national laboratories, and it explicitly adds critical infrastructure—such as drinking water—as a factor in national-security considerations. In addition, the bill requires an annual, agency-by-agency review by CFIUS members of U.S. government facilities and property deemed sensitive for national security or critical infrastructure reasons, with a formal, annually updated report to the chairperson approved by an Assistant Secretary or equivalent official. It also requires a list of related notices and reviews to be maintained and made available for annual review, and provides for classified briefings to Members of Congress upon request.
